Terms of Service

The rules that govern Byta AI accounts, creative tools, AI Friends, generated output, credits, subscriptions, acceptable use, and service availability.

Last updated: July 27, 2026

Byta AI is operated by ByteMe Digital Creation Studio. In these Terms of Service, "Byta," "we," "us," and "our" refer to Byta AI and ByteMe Digital Creation Studio as the operator of the Services. These Terms govern your access to and use of our website, applications, chat features, upload features, AI Friends and character publishing features, Studio image and video generation features, billing features, and related services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be able to form a binding contract in your jurisdiction and meet the minimum age required by law to use the Services. The Services are not directed to children under 13, or the higher minimum age required by applicable law.

You are responsible for providing accurate account information, safeguarding your credentials, and all activity that occurs under your account or session. You must notify us promptly if you become aware of unauthorized access or misuse.

Some features may be available in guest mode, but we may require registration, email verification, payment, or additional security checks for certain features or higher usage levels.

2. The Services

Byta is an AI product that currently includes features such as chat, file uploads, saved chat history, AI Friends, public and private character creation, image generation, video generation, billing, and related account tools. Features may change over time, and certain features may be added, removed, restricted, or made subject to separate requirements.

We may use third-party providers to operate the Services, including model providers, hosting and infrastructure providers, email vendors, security vendors, anti-abuse vendors, and payment processors. Availability of the Services may depend on those providers.

3. Acceptable use

You agree not to:

  • use the Services for unlawful, fraudulent, deceptive, abusive, or infringing activity;
  • submit content you do not have the right to use, disclose, or process;
  • attempt to bypass safety systems, billing rules, storage limits, rate limits, or account restrictions;
  • probe, scan, disrupt, overload, or test the vulnerability of the Services or related systems without authorization;
  • interfere with other users, accounts, or infrastructure;
  • use the Services to develop, improve, or benchmark competing models or services through unauthorized extraction, scraping, or reverse engineering of protected service behavior or internals;
  • upload malware, exploit code, or disallowed files, or use the Services to distribute harmful content or instructions;
  • publish AI Friend characters, avatars, prompts, bios, tags, opening messages, or other public-facing content that violates law, infringes rights, impersonates others without permission, exposes private information, or is abusive, deceptive, hateful, sexualized involving minors, exploitative, or otherwise harmful;
  • misrepresent that AI-generated output is human-authored, independently verified, or endorsed by Byta when it is not.

4. Your content

You may provide prompts, messages, files, reference materials, and other content to the Services ("Input"), and the Services may return responses, generated media, and other results ("Output"). As between you and us, and to the extent permitted by law, you retain whatever rights you have in your Input.

You are responsible for your Input, for having all rights needed to submit it, and for your use of any Output. You must not submit confidential, personal, regulated, or third-party material unless you have the right and a lawful basis to do so.

You grant us and our service providers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, adapt, and display your Input and Output as reasonably necessary to operate, secure, maintain, improve, audit, support, and comply with law in connection with the Services.

If you choose to make an AI Friend character or other content public, you also authorize us to display, distribute, index, preview, moderate, and make that public content available to other users through the Services. You should not publish secrets, sensitive personal information, or material you do not want other users to see.

5. AI output and important limitations

The Services use machine learning and other automated systems. Output may be inaccurate, incomplete, misleading, offensive, delayed, unavailable, or not unique. Similar or identical output may be generated for other users.

You are responsible for reviewing Output before using or relying on it. Do not use the Services or Output as a substitute for professional advice, or in high-risk contexts where errors could cause death, bodily injury, legal liability, financial loss, regulatory harm, or other serious consequences, without appropriate human review and safeguards.

6. Chats, AI Friends, public content, uploads, and storage limits

For signed-in users, chats may be saved to account history unless you use temporary chat mode or another feature that clearly states the conversation will not be saved in the same way. Guest-mode experience, saved history, and other persistence features may be different or unavailable.

AI Friend characters may be private or public depending on the visibility setting you choose. Public characters and their public-facing fields may be shown to other users, may be searchable or discoverable in the Services, and may be used by other users to start chats. We may review, hide, restrict, take down, or delete public or private characters and related content when we reasonably believe doing so is necessary to enforce these Terms, protect users, respond to complaints, comply with law, or operate the Services.

Uploads and generated media are subject to account storage limits and product behavior. The current implementation may automatically prune older uploaded files for an account when a new upload would exceed the applicable storage limit. You are responsible for keeping your own backups of important content.

7. Paid plans, credits, and subscriptions

Byta may offer free usage, recurring paid plans, and one-time purchases such as credit packs. Pricing, plan entitlements, available currencies, and feature limits may change over time.

Credits are a contractual usage unit for the Services. Credits are not bank accounts, stored value, deposits, cash equivalents, or property, and they have no cash redemption value except where required by law. Recurring credits may reset on the schedule used by our systems. Permanent credits may be granted or purchased under plan or pack terms presented at checkout. Permanent credits do not expire in the normal course while your account remains active and in good standing, but your ability to use any credits may be limited, suspended, reversed, forfeited, or made unavailable if we reasonably believe there is abuse, fraud, payment reversal, chargeback activity, unauthorized access, account compromise, stolen-account activity, legal risk, violation of these Terms, or another security or operational reason that requires restricting the account or credits.

If you purchase a subscription, it may renew automatically each billing period until canceled. You are responsible for applicable taxes, fees, and charges presented at checkout. You may be able to manage or cancel recurring billing through the payment processor's billing portal when that feature is available.

All sales are final. To the maximum extent permitted by law, fees, subscriptions, renewals, credit purchases, and other charges are non-refundable, including for partial billing periods, unused credits, accidental purchases, feature changes, dissatisfaction with output, or account inactivity. We may change pricing, credit allocations, plan features, and eligibility prospectively. Any such change will not create a refund right for prior charges unless applicable law requires otherwise.

8. Third-party services

The Services may depend on third-party providers, including model providers, payment processors, email providers, hosting providers, and anti-abuse providers. Your use of third-party functionality may also be subject to those providers' terms and policies. We are not responsible for third-party services except as required by applicable law.

9. Suspension and termination

We may suspend, restrict, or terminate your access to some or all of the Services if we reasonably believe you violated these Terms, created security or abuse risk, failed to pay applicable charges, exposed us or others to legal risk, used or controlled a stolen or compromised account, created chargeback or payment risk, or if suspension is otherwise necessary to protect the Services, users, or third parties.

Suspension or termination may limit access to content, chats, uploads, public AI Friend characters, subscriptions, credits, or other account benefits. Where reasonable, we may use temporary restrictions or security holds while we investigate suspected abuse, fraud, unauthorized access, or account compromise.

You may stop using the Services at any time. Termination or suspension does not affect rights or obligations that by their nature should survive, including payment obligations, disclaimers, liability limitations, and rights relating to prior content or legal compliance.

10. Intellectual property and feedback

The Services, including the software, interface design, branding, documentation, and underlying technology, are owned by Byta, its licensors, or other rights holders and are protected by intellectual property and other laws.

If you provide suggestions, ideas, or feedback about the Services, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback without restriction or compensation, unless applicable law requires otherwise.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND AVAILABILITY.

We do not guarantee uninterrupted, secure, error-free, or loss-free operation, or that Output will be accurate, lawful, unique, or suitable for your needs.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTA AI, BYTEME DIGITAL CREATION STUDIO, AND THEIR AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain liability limitations, so some of the above limitations may not apply to you.

13. Changes to the Services or these Terms

We may change, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. If we make a material change, we will post the updated Terms here and revise the "Last updated" date, and we may provide additional notice when appropriate.

Except where prohibited by law, your continued use of the Services after updated Terms become effective means you accept the revised Terms.
